This is the Privacy Policy for Iris Media, Inc., dba Trifoia and our affiliates and subsidiaries (collectively, “Trifoia”, “us”, or “we”).It is governed by and part of our Terms of Use. Any terms used in this Privacy Policy not defined herein are defined as provided in the Terms of Use. Any additional notices we may provide to you about our privacy practices will be considered to form part of this Privacy Policy.
This Privacy Policy describes how we treat information collected through our websites and online platforms listed in our Terms of Use (collectively, the “Site”) to develop, manage, deliver, and support instructional content (“Courses”) through the Site and related software and services (collectively, our “Services”). This Privacy Policy does not apply to any websites or platforms not owned or operated by Trifoia, such as a Client’s or other third party’s website or platform, even if accessible from Trifoia’s Services.
Please read this Privacy Policy carefully to understand our privacy practices. If you do not agree with this Privacy Policy, you must not access or use our Services. If you have questions or would like to make a complaint, please contact us at contentagent@trifoia.com.
1. What Does “Personal Information” Mean?
As used in this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual consumer or household. To give you a sense of scope, below are examples of categories of information that is legally protected as Personal Information:
- Identifiers (e.g., name, email, telephone number, address, username);
- Sensitive Personal Information (e.g., government identification number; precise geolocation; racial or ethnic origin; religious beliefs; health data; contents of messages when we are not the recipient; in some cases, information about a known child);
- Legally protected information (e.g., race, citizenship, marital status, sex);
- Employment-related information (e.g., current or past employment);
- Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);
- Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;
- Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);
- Internet or other similar activity (e.g., browsing history; content interactions); and
- Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes.
The above list are examples only. Trifoia limits its collection of Personal Information to what is necessary to provide the Services. Trifoia does not collect all of the above categories of Personal Information. Also, not all information about you is legally protected as Personal Information. Depending on where you live, publicly available information, aggregated information (meaning data summaries or reports with Personal Information removed), employment-related information, or anonymized information (that cannot be linked back to you as an individual) may not qualify as “Personal Information.”
2. How Does Trifoia Collect and Process Personal Information?
The Personal Information we collect about you and the manner of collection depends on how you interact with the Services. When you submit Personal Information to Trifoia for us to process directly, we process that Personal Information as a controller. If we process Personal Information on behalf of our Clients, we do so as a service provider or processor to that Client. In all cases, Trifoia limits the collection, use, disclosure, and retention of Personal Information to what is necessary to accomplish the purposes described in this Privacy Policy, or notified at the time of collection, or as authorized by you directly or through the Client.
a. What Categories of Personal Information Are Collected?
Trifoia only collects and processes your Personal Information: (i) with your consent as informed by this Privacy Policy and freely given at the time you provide the information; (ii) to perform our contractual obligations; (iii) with a legitimate interest; or (iii) as authorized or required by law. During the preceding 12 months, Trifoia has collected these categories of Personal Information:
- Identifiers;
- Internet or other similar activity; and
- Sensitive Personal Information, collected with your consent and only in certain cases where necessary for a research study and as provided by the individual.
We will notify you before we collect additional categories of Personal Information or use your Personal Information for purposes that are incompatible with the purpose stated at the time of collection.
b. How is the Personal Information Collected?
Trifoia collects and process Personal Information through the Site and other Services as a controller, or as a processor when processing the Personal Information on behalf of a Client. Trifoia collects Personal Information from these sources:
- Your registration and activity on one of our Learning Management Systems. Trifoia makes Courses available via a third-party hosting platform for learning and training content called a Learning Management System (“LMS”). Most of our Courses are available on TalentLMS, but we may use another LMS for certain types of Courses. In any case, to purchase or access a Course, you will be directed to register and login to the appropriate LMS. Please note that when you interact with a Course on the LMS, data from those interactions are collected and used by that LMS and shared with Trifoia. Please review the relevant privacy policy to understand the treatment of your Personal Information on the LMS.
- When you sign up to access certain Courses. If you sign up to receive access to a Course, Trifoia may prompt you to provide information related to the requested Course. For example, to access a Course related to divorce, you may be asked to provide the state and county in which your divorce proceeding is being processed. We collect this information with your consent, and we use it to provide you with access to the Course you request. To purchase a Course, you will be directed to click a “Continue to Purchase” or a similar button, which will redirect you to a site hosted by the LMS where the Course is hosted.
- To apply a fee waiver for any Course related to your court proceeding, you must submit your first and last name, phone number, email address, a copy of your signed court-issued Indigent Status or Forma Pauperis form, the case number associated with your form, and the county and state in which the form was issued. You provide this information with your consent. Trifoia uses this information to evaluate your eligibility for the waiver and, if we can confirm your eligibility, to contact you with information regarding how to create and login to the Course related to your court proceeding.
- Your participation in a Course. During the Course, if you enable your camera or microphone and participate by video or audio, the Services may capture and record your image or voice, along with any information you volunteer. Some Courses may ask you to participate in certain exercises or activities. As part of your participation, you may be asked to provide information about your relationships, parenting practices, or other personal experiences. These exercises may be completed verbally or in writing depending on the Course. You control the information you provide in these circumstances. This information is collected with your consent when you make it available during the Course, and we will only use this information in the context of the Course and not for any other purpose.
The Course facilitator, other participants, or others may have access to that information, and Trifoia cannot control how that information may be used by others. Trifoia does not monitor your Course participation or any information you make available to the Course facilitator, other participants, or any other party during the Course. You are solely responsible for any Personal Information you make available to others during the Course and for all outcomes of doing so.
- If you participate in a research study. Trifoia conducts research studies related to the subject matter of certain Courses we offer. If you participate in a research study, you may be asked to provide sensitive Personal Information such as age, gender, sexual orientation, relationship status or other details relevant to the research study. Trifoia collects this information with the participant’s informed consent and uses it to determine eligibility and, if the participant is included in the research study, to analyze data and produce results for the research study.
- When you contact Trifoia. If you contact Trifoia online, by email, or other means, we will collect your name, email address and other necessary information to respond to your inquiry. We collect this information with your consent, and we use it for the purposes stated at the time of collection, to provide you with our Services, to provide you with technical or customer support, to communicate with you, or market to you according to your stated preferences. You can unsubscribe from our mailing list at any time using the “UNSUBSCRIBE” link we include in marketing messages.
- As instructed by a Client. Trifoia is a service provider to our clients that use our Services to develop, manage, deliver, and support Courses on our Services (each a “Client”). A Client may submit Personal Information to Trifoia on your behalf, or we may collect and process your Personal Information as instructed by the Client. Where Trifoia acts as a service provider to Clients, the Client is responsible for providing Trifoia with instructions and authorizations for processing your Personal Information, limiting the collection and use of Personal Information to what is necessary, and informing you about and supporting the exercise of your privacy rights. This means the Client determines the categories of Personal Information to be collected and how the Client will use that information according to the Client’s own privacy practices (not ours).
- Automatically when you use our Services, with a legitimate interest. When you visit the Site or interact with a Course, we collect technical data about your device and session (e.g., IP address, browser type, generalized geolocation, language, session connection and disconnection time, bandwidth and referring URL) to provide you with technical support and to analyze and improve our Services.
- Cookies and Related Technologies. Trifoia uses cookies and related technologies to collect technical data related to your use of the Services. Please see the cookie consent mechanism on our website for details about the types of cookies and related technologies used on the website and your options to control how those technologies interact with your device. You can use the cookie consent tool on the website to opt out of cookies that are not essential to the functionality of the website by selecting “Reject All” or customizing to only permit essential cookies. You can also block or purge cookies from your device by adjusting your device settings.
c. How Else Does Trifoia Use Personal Information?
In addition to the specific uses described above, we might also use your Personal Information to (i) monitor your compliance with your agreements with us; (ii) protect your privacy and enforce this Privacy Policy; (iii) if we believe it is necessary, to identify, contact, or bring legal action against persons or entities who may be causing injury to you, to us, or to others; (iv) comply with a law, regulation, legal process, or court order; or (v) fulfill any other purpose to which you consent. We will not collect additional categories of Personal Information or use already collected Personal Information for purposes that are materially different, unrelated, or not reasonably necessary or compatible with the original purpose without notice and consent to you as required by law.
d. Should Children Use the Services?
The Site is for adults, not children, and most of our Courses are designed for adults only. In rare cases, we may host a Course designed for individuals under the age of 18 and we only permit children to engage with those Courses with parent or guardian consent or assistance. Do not use our Services if you are under the age of 18 unless your parent or legal guardian has consented to Trifoia in writing. As part of our commitment to compliance with children’s privacy protections, we encourage you to contact us at contentagent@trifoia.com if you believe we might have collected any information online from a child so that we can delete it.
e. What About Payment Information?
Trifoia does not collect or process payment information. If you make a purchase through our Services, you will be redirected to a secure third-party payment gateway, such as Stripe or Shopify. Payments made through payment gateways are subject to the payment gateway’s privacy policy, not ours. Trifoia is not responsible for the privacy policies of our third-party payment gateways as it relates to data like payment data that does not reside on our servers. Trifoia may keep small amounts of non-sensitive data, such as the last four numbers of a credit card, for limited administrative purposes.
3. How Long Does Trifoia Retain the Personal Information?
Trifoia’s policy is to retain Personal Information only for as long as necessary to accomplish the purposes stated at the time of collection or described in this Privacy Policy. We may also retain Personal Information for other purposes that are compatible with the original purpose of collection or as informed by our company retention policies. For example:
- Data associated with your participation in a Course will be retained for up to 7 years after your completion date.
- Your TalentLMS account data is retained as long as your account remains active. TalentLMS will delete your Personal Information on its systems according to its policies and practices.
- Data collected through cookies may be retained for a few minutes or for several months, depending on the cookie’s purpose and functionality.
Trifoia reserves the right to also retain and use Personal Information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
4. Does Trifoia Disclose Personal Information to Third Parties?
a. Which Personal Information Is Disclosed ?
Trifoia will only disclose your Personal Information with your permission, as described in this section, or as required by law. In the preceding 12 months, Trifoia has disclosed Personal Information we collected through the Services to third parties for one or more business purposes as detailed in paragraph b below. We will not disclose Personal Information to third parties except as described in this section or with your consent. Trifoia will be responsible for all onward transfers of Personal Information to our subcontractors and other disclosure recipients.
b. Who Receives the Disclosed Personal Information?
Personal Information may be disclosed to the following recipients:
- Our Sub-Processors. Third-party service providers that provide us with services like web hosting providers, payment processors, email management services, and analytics services may have access to your Personal Information to perform their contractual obligations to Trifoia. The type of information that we provide to a service provider depends on the scope of its services. Trifoia contractually prohibits these service providers from selling or sharing the Personal Information, and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information. A list of our current service providers is available upon request by emailing contentagent@trifoia.com.
- The Client for the Course. The Client associated with the Course you select will have access to your registration information and whether you completed or passed the Course. For example, if you complete a Course as required by a court order, we may be required to report your completion of the Course to the relevant court or other agency.
- Course Participants. Depending on the Course format and contents, when you participate in a Course your name may be visible to other participants. If you share Personal Information about yourself during the Course, the facilitator or participants may have access to that information.
- Cookie information recipients, subject to their respective privacy notices. See our Cookie Notice for details.
- Affiliates and Other Third Parties. Trifoia may disclose the Personal Information we collect to our business affiliates or subsidiaries. Their use and disclosure of your Personal Information will be subject to this Privacy Policy. Additionally, under some circumstances we may disclose Personal Information we collect as permitted by applicable law, for example: if we go through a business transition (e.g., merger, acquisition, or sale of a portion of our assets); to comply with a legal requirement or a court order; when we believe it is appropriate in order to take action regarding illegal activities or prevent fraud or harm to any person; to exercise or defend our legal claims; or for any other reason with your consent.
- Law enforcement, and other governmental agencies. In some rare cases, Trifoia may be required to disclose, and may disclose, Personal Information in response to lawful requests by public authorities. It is our policy in these cases to only disclose Personal Information when and to the extent required to comply with applicable law.
- Aggregated and Deidentified Information. Trifoia reserves the right to share aggregated, anonymized, or deidentified information about any individuals with nonaffiliated entities for marketing, advertising, research or other purposes, without restriction.
5. What Controls and Legal Rights Are Available to Me?
a. Can I Control My Personal Information on Trifoia?
Trifoia gives you the ability to directly control the Personal Information we collect and hold about you through our Services:
- Your TalentLMS Account. To request a correction, update, or to delete Personal Information associated with your account, please contactsupport@trifoia.com. Trifoia customer support will make changes as permitted. Please note, however, that changes to Personal Information may not be permitted in some cases.
- Reminder Emails and Text Messages. We may send you informational or support emails or text messages related to a Course or your other use of our Services. For example, you may receive reminders about Course content or a notification when the next Course section or module is unlocked. You can unsubscribe from these reminder emails or text messages anytime. You are responsible for your own Course completion and progress tracking, whether or not you receive these reminder messages from us.
- Text Message Consent and Opt-Out. If you provide us with your wireless number, you consent to Trifoia sending you text messages for informational or authentication purposes. If you opt-in to our marketing texts, we will also use your wireless number to send you texts about offers, promotions, or ads. The number of texts that we send to you will be based on your circumstances and requests. You can unsubscribe from text messages by replying STOP or UNSUBSCRIBE to any of the text messages we send to you. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.
- Marketing Emails. Depending on your communication preferences, we may also send you marketing emails. If you do not wish to receive emails from Trifoia, you can unsubscribe or change your preferences via the links provided in the emails or send a request to support@trifoia.com to be removed from our email list. If you opt out of our marketing communications, we may still send you non-promotional communications, such as those about your Courses or TalentLMS account.
- Device Settings. You can control how we automatically collect certain data by adjusting your device settings.
- Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, Trifoia systems do not recognize browser “do-not-track” requests.
- Privacy Requests. Depending on where you reside, you may be entitled to additional controls over your Personal Information. Read more about privacy rights that may be available to you in Section 5(b) (What Are My Privacy Rights?). If you wish to exercise your privacy rights beyond the methods described above, or if you want to express concerns, lodge a complaint, or request information, please submit a verifiable Privacy Request by email to contentagent@trifoia.com.
Trifoia may only legally fulfill a Privacy Request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so, such as requests that are excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting contentagent@trifoia.com.
If Trifoia collects or processes your Personal Information as a service provider to a Client, we will relay your request to the Client for further processing. We will cooperate with the Client’s instructions to honor your requests and privacy choices.
b. What Are My Privacy Rights?
This section provides informational notices pursuant to consumer privacy laws that require companies to inform consumers about their privacy rights, such as the European Union’s General Data Protection Regulations and its counterpart in the United Kingdom, U.S. privacy laws such as the California Consumer Privacy Act and other state laws providing privacy rights to consumers, and Canada’s Personal Information Protection and Electronic Documents Act and Québec’s provincial privacy law. Some or all the protections afforded under these laws may not apply to Trifoia or your use of our Services. Trifoia will support your exercise of privacy rights to the extent a consumer privacy law applies to your use of our Services, subject to statutory exceptions and limitations.
Depending on where you live, your rights over your Personal Information may include some or all of the following:
- · Right to Know. You have the right to know how we collect and process your Personal Information. We have set the required notices in this Privacy Policy. We may provide you with additional notices about other ways we process your Personal Information, such as by sending you a notice via email or by other means of communication.
- Right to Expect. You can expect us to collect, use or disclose Personal Information responsibly and not for any purpose other than which you consented. We set your expectations in this Privacy Policy, and we collect legally required consent at various stages of our interactions with you. If we collect or use your Personal Information based on your consent, we will also notify you of any changes and will request your further consent as required by law. You may withdraw your consent at any time with reasonable notice by contacting contentagent@trifoia.com.
- Right to Correct. You have the right to the accuracy of your Personal Information and the right to request that we correct inaccurate Personal Information about you on our systems. If you become aware that the Personal Information that we hold about you is incorrect, or if your information changes, please inform us and we will update our records.
- Right to Deletion. You have the right to request that we delete or dispose of your Personal Information processed on our systems, with certain exceptions. Trifoia may permanently delete, deidentify, or aggregate the Personal Information in response to a request for deletion. If you delete your Personal Information, it may be impossible for Trifoia to continue providing the Services to you.
- Right to Access. You may request confirmation that we have collected Personal Information about you and that we provide you with access to that Personal Information. If you submit an access request, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that certain laws may prohibit Trifoia from disclosing specific pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.
- Right to data portability. In some cases, we are required to provide your Personal Information to another organization at your request and in a structured, commonly used machine-readable format, so that the other organization can read and use it.
- No Sale or Sharing. Some states entitle consumers to opt out of the sale or sharing of Personal Information or targeted advertising practices.Trifoia does not sell your Personal Information or share your Personal Information with third parties for cross-contextual behavioral advertising purposes. If this changes in the future, we will update this Privacy Policy and provide you with a method to opt out of such sale and sharing.
- Limited Use and Disclosure of Sensitive Personal Information. You have the right to opt out or limit our use of your sensitive Personal Information. Trifoia does not seek to collect sensitive Personal Information from any individual. However, a Client may instruct us to collect sensitive Personal Information for certain Courses. Your submission of sensitive Personal Information via the Services is your choice and is done with your consent. In no case will Trifoia use or disclose any sensitive Personal Information for the purpose of inferring characteristics about you.
- No Automated Decision-Making or Profiling. You have the right to opt out of automated decision-making or profiling. Trifoia does not use any form of automated processing of Personal Information to evaluate, analyze, or predict your performance, preferences, choices, or behavior. But we have no control over whether Client uses data collected through the Services in a manner that qualifies as ADM or profiling. Please contact the Client if you have questions about automated use of your Personal Information.
- Right to Disclosure. You may request that we provide you with certain details about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) categories of our team members who have access to your Personal Information and Trifoia’s business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (iv) the categories of third parties with whom we share that Personal Information; and (v) if we sold or shared your Personal Information under certain privacy laws, two separate lists stating: (a) for sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (b) for disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.
- Right to Restrict. You may have the right to request that we restrict the processing of your Personal Information if (i) the data is inaccurate, (ii) the processing is unlawful, (iii) we no longer need the Personal Information, or (iv) you exercise your right to object. Your right to restrict may be limited to Personal Information that is sensitive in nature, or that is sold or shared for certain purposes.
- Right to Object. You may have the right to request, under certain circumstances and where we are required to do so by law, that we limit our processing of your Personal Information as you request.
- Health Data Rights. The Services are not designed to be used to collect health data. Please do not submit any health data through the Services. Some laws entitle consumers to certain details about health data collected about them, including (i) confirmation of whether the entity collects, shares, or sells the consumer’s health data and access that data, including a list of all third parties and affiliates with whom the entity has shared or sold the health data and a method to contact those third parties, (ii) a method to withdraw consent related to use of health data, and (iii) the right to have their health data be deleted.
- Right to Nondiscrimination. Trifoia will not discriminate against you for exercising your privacy rights. For example, unless permitted by law, we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.
- Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.
To exercise your rights or ask questions, please contact contentagent@trifoia.com. In cases where your request must be submitted to the applicable Client we will instruct you to do so.
6. How is My Information Kept Secure?
Trifoia is committed to safeguarding the Personal Information entrusted to us. We have implemented and maintained reasonable and appropriate security measures to help protect Personal Information in our possession from unauthorized access, processing, alteration, or disclosure. We use a combination of technical and organizationalmeasures, procedures, and standards to govern Personal Information processing and safeguard the datain our possession. For example, we use multi-factor authentication, industry standard SSL for data encryption, proprietary technology, and other technical safeguards to protect information online and stored on our systems. Only trained and authorized employees and subcontractors may access Personal Information, and only when necessary for a specific business reason. Employees and/or contractors who violate our policies are subject to disciplinary action, up to and including termination. Our security measures are designed to meet our duty of care related to your Personal Information. Please note, however, that no transmission of data over the Internet is 100% secure, and we cannot guarantee that unauthorized third parties will not defeat our security measures or use your Personal Information for improper purposes.
You are encouraged to take steps to protect against unauthorized access to your password, links or other access mechanism to Courses you select, and your device(s) by choosing a robust password that nobody else knows or can easily guess, keeping your password and links private, and signing off after using a shared device. Trifoia is not responsible for any lost, stolen, or compromised passwords, or for any unauthorized activity using your login credentials or any link.
7. Consent to Cross-Border Data Transfers.
Trifoia is owned and operated in the United States. When transferring Personal Information across jurisdictional borders, we take measures to comply with applicable data protection laws related to such transfer. When your information is moved from your home country to another country, the laws and rules that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is transferred to the United States, it may be accessed by government authorities under United States law. When a transfer of Personal Information requires a lawful data transfer mechanism, Trifoia relies on one or more of the following mechanisms:
- Transfer to countries or recipients that are legally recognized as having an adequate level of protection for Personal Information.
- EU Standard Contractual Clauses approved by the European Commission and the UK International Data Transfer Addendum issued by the Information Commissioner’s Office.
- Other lawful methods available to Trifoia under applicable law.
Trifoia engages in cross-border data transfers on the legal basis that doing so is necessary to provide the Services to Clients and their end users. However, we do not warrant that Trifoia is appropriate or authorized for use in other jurisdictions. Clients and end users are solely responsible for determining whether their use of the Services complies with applicable laws. By allowing us to collect Personal Information about you, you consent to the transfer and processing of your Personal Information as described in this section.
8. What About Links to Third Party Services ?
The Services may contain links to services owned or operated by third parties. For example, TalentLMS is a third-party platform that is accessible via a link from our Services. Trifoia has no ability to control and is not responsible for privacy and data collection, use, and disclosure practices of third-party services, including Client privacy practices. You are encouraged to read the privacy statements of each service that collects your Personal Information.
9. Will this Privacy Policy Change?
Trifoia reserves the right to update this Privacy Policy from time to time. The date that this Privacy Policy was last updated is at the top of this page. Your continued use of the Services after we post updates is deemed to be your acceptance of the corresponding changes to our privacy practices.
